3. Website Information

We make reasonable efforts to keep the information on this website accurate and up to date.

However, website content is provided for general information and should not be treated as a final quotation, technical specification, contractual commitment or professional advice.

Service descriptions, photographs, examples, estimated costs, project information and other website content may change without prior notice.

Actual project requirements, materials, costs, timelines and specifications will be confirmed separately following consultation, site inspection, design development and/or quotation, where applicable.

4. Project Enquiries

Submitting an enquiry through our website, email, telephone, WhatsApp or another communication channel does not automatically create a contract between you and Marbella Prime.

An enquiry allows us to understand your requirements and determine whether we can provide the requested service.

We may request additional information, drawings, photographs, measurements, property details, access information or other documents before preparing a quotation.

5. Quotations and Proposals

Where applicable, we may provide a quotation or project proposal after reviewing your requirements.

A quotation may include:

  • Description of the proposed work
  • Materials and finishes
  • Labour and installation
  • Project scope
  • Estimated duration
  • Payment terms
  • Applicable exclusions
  • Additional conditions

Unless specifically stated otherwise, website prices, estimates or general cost information are not binding quotations.

A quotation is subject to the scope and assumptions stated in that quotation. Changes to the project, materials, specifications, site conditions or client requirements may result in additional costs.

A project becomes binding only when the relevant quotation, proposal, contract or work order has been accepted in accordance with its stated terms.

6. Site Conditions and Existing Property

Renovation and technical work can involve existing structures, plumbing, electrical systems, air-conditioning systems, walls, ceilings and other building components.

Some conditions may not be visible before work begins.

If previously unknown site conditions are discovered, additional investigation, work, materials, approvals or costs may be required.

Where this occurs, we will communicate the relevant requirements to the client before proceeding with additional work where reasonably practicable.

7. Changes to Project Scope

Any work outside the agreed project scope may be treated as additional work.

Examples include:

  • Changes requested by the client after approval
  • Additional rooms or areas
  • Changes to selected materials or finishes
  • Additional electrical, plumbing or MEP requirements
  • Structural or site conditions discovered during work
  • Additional authority, landlord or developer requirements
  • Additional design or installation requirements

Additional work may affect the project cost and completion date.

Where applicable, additional work will be confirmed through a variation, revised quotation or written approval.

8. Project Timelines

Any project completion date or estimated duration provided by Marbella Prime is based on the agreed scope and the information available at the time.

Project schedules may be affected by matters outside our reasonable control, including:

  • Approval or permit processing
  • Client decisions or delays
  • Material availability
  • Changes to project scope
  • Site access restrictions
  • Building or landlord requirements
  • Utility or authority requirements
  • Unforeseen site conditions
  • Delays caused by third parties
  • Events beyond our reasonable control

We will make reasonable efforts to keep projects progressing according to the agreed schedule.

9. Approvals and Permissions

Certain renovation, fit-out, structural, MEP or technical works may require approvals, permits, NOCs or permissions from relevant authorities, developers, landlords, building management or other parties.

Where approval assistance is included in the agreed scope, Marbella Prime may coordinate or assist with the relevant process.

Approval requirements depend on the property, project type, location, building management and applicable regulations.

Clients must provide accurate information and cooperate with reasonable requests for documents or approvals.

No website statement should be interpreted as a guarantee that a particular approval will be granted.

10. Materials and Finishes

Materials, products, fixtures, fittings and finishes will be selected according to the agreed project scope.

Where a specific product or material is unavailable, discontinued or subject to supply constraints, an alternative may be proposed.

Any material substitution should be agreed with the client where it materially affects the approved specification.

Natural materials and manufactured products may have variations in colour, texture, grain, pattern or finish. Such variations are not necessarily defects.

11. Client Responsibilities

The client is responsible for providing accurate information required for the project and for ensuring reasonable access to the property.

The client should also:

  • Provide necessary approvals or property documents when requested.
  • Provide timely decisions and approvals.
  • Inform us of known property defects or restrictions.
  • Provide access to the site at agreed times.
  • Make payments according to the agreed payment schedule.
  • Obtain any permissions that are specifically the client’s responsibility.
  • Ensure that information supplied to us is accurate and complete.

Client delays may affect project costs and completion dates.

12. Payments

Payment terms will be specified in the applicable quotation, proposal, contract or invoice.

The client agrees to make payments by the agreed due dates.

Late or missed payments may affect project scheduling, procurement or continuation of work where permitted by the applicable agreement.

Any payment dispute should be raised with Marbella Prime promptly so that the matter can be reviewed.

13. Cancellations and Termination

Cancellation or termination of a project will be subject to the applicable quotation, contract or project agreement.

Where work, materials, design services, procurement or other costs have already been incurred, the client may remain responsible for applicable amounts under the agreed terms.

Specific cancellation or refund conditions may vary depending on the project and will be stated in the relevant agreement where applicable.

14. Warranty and Defects

Where a warranty or workmanship guarantee is provided, its duration and scope will be stated in the applicable quotation, contract or warranty document.

Warranty coverage may be subject to the relevant terms and exclusions.

Warranty claims may not cover damage caused by misuse, unauthorised alterations, normal wear and tear, third-party work, lack of maintenance, accidents or circumstances outside our control.

15. Third-Party Products and Services

Some projects may involve products, equipment, manufacturers, suppliers, developers, landlords, authorities or other third parties.

Where a product or service is supplied by a third party, its own warranty, terms and conditions may apply.

We will not be responsible for matters that are solely within the control of an independent third party, subject to applicable law and the terms of the relevant project agreement.

16. Website Images and Project Photography

Images displayed on this website may show completed projects, design concepts, materials, products or illustrative examples.

Actual results may vary depending on the property, dimensions, materials, lighting, finishes and project requirements.

We may display photographs of completed projects for portfolio and marketing purposes where we have the appropriate permission to do so.

Clients who do not wish project images to be used publicly should communicate their requirements to us.
